Form for informing the traveler on a package holiday pursuant to §651A of the German Civil Code

Information for the traveler

The combination of travel services offered to you is a package holiday within the meaning of Directive (EU) 2015/2302.

Therefore, you can take advantage of all EU rights that apply to package travel. van der Valk Freizeit und Touristik GmbH bears full responsibility for the proper performance of the entire package.

In addition, van der Valk Freizeit und Touristik GmbH has the legally required protection for the repayment of your payments and, if transport is included in the package holiday, to ensure your repatriation in the event of its insolvency.

Key rights under Directive (EU) 2015/ 2302

  • The travelers receive all essential information about the package tour before the conclusion of the package travel contract.

  • At least one entrepreneur is always liable for the proper performance of all travel services included in the contract.

  • The travelers receive an emergency telephone number or details of a contact point through which they can get in touch with the tour operator or the travel agency.

  • The travelers can transfer the package holiday – within a reasonable period and, in some cases, at additional cost – to another person.

  • The price of the package tour may only be increased if certain costs (for example fuel prices) increase and if this is expressly provided for in the contract, and in any case no later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveler may withdraw from the contract. If a tour operator reserves the right to increase the price, the traveler has the right to a price reduction if the corresponding costs decrease.

  • The travellers may withdraw from the contract without payment of a cancellation fee and receive a full refund of all payments if one of the essential components of the package holiday, with the exception of the price, is substantially changed When the trader responsible for the package holiday cancels the package holiday before the start of the package holiday, the travellers are entitled to a reimbursement of costs and, in some cases, to compensation.

  • Travelers may, upon the occurrence of extraordinary circumstances before the start of the package holiday, withdraw from the contract without paying a cancellation fee, for example if there are serious security problems at the destination that are likely to affect the package holiday.

  • In addition, travelers may withdraw from the contract at any time before the start of the package tour by paying a reasonable and justifiable cancellation fee.

  • If, after the start of the package tour, essential components of the package tour cannot be carried out as agreed, the traveler must be offered reasonable alternative arrangements at no extra cost. The traveler may withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany this right is called "termination") if services are not provided in accordance with the contract and this has a significant impact on the provision of the contractual package tour services and the tour operator fails to remedy the situation.

  • The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided properly.

  • The tour operator provides assistance to the traveler when he finds himself in difficulties.

  • In the event of the insolvency of van der Valk Freizeit und Touristik GmbH, payments will be refunded. If the insolvency of van der Valk Freizeit und Touristik GmbH occurs after the start of the package travel and transport is part of the package travel, the return transport of the travelers will be guaranteed. Van der Valk Freizeit und Touristik GmbH has taken out insolvency protection with R+V Allgemeine Versicherung. Travelers can contact R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, +49 611 533-5859, if services are refused to them due to the insolvency of van der Valk Freizeit und Touristik GmbH.
